Contractual terms for the use of Evermora
This English version is a simplified summary for convenience. The German version is legally binding.
§ 1 Scope
These terms apply to all contracts between Leftclick AG (the "Provider") and the customer (the "User") concluded via the platform. Deviating terms of the User are not accepted unless expressly agreed in writing.
§ 2 Subject of Contract
The contract covers use of the online platform for creating and managing digital diary entries. The platform is offered in two subscription tiers: Free (limited features) and Premium (full feature set).
§ 3 Conclusion of Contract
The contract is formed when the User registers on the platform and the Provider confirms registration. By registering, the User agrees to these terms. The User must be at least 18 years old or have parental consent.
§ 4 Prices and Payment
Current prices for paid subscriptions are shown on the website. All prices include applicable VAT. Payment is made in advance via the offered payment methods (credit card, SEPA direct debit). Annual billing receives a discount compared to monthly billing.
§ 5 Term and Cancellation
Paid subscriptions renew automatically for the chosen period unless cancelled in time. Cancellation is possible at the end of each billing period via account settings or email. After cancellation, the account reverts to the free tier. Extraordinary termination for good cause remains unaffected.
§ 6 Usage Rights and Obligations
The User receives a non-exclusive, non-transferable right to use the platform for private purposes. The User must keep credentials confidential, must not upload unlawful content, must not misuse the platform, and must not use automated access. The User retains all rights to uploaded content.
§ 7 Privacy
Personal data is processed in accordance with our Privacy Policy.
§ 8 Liability
The Provider is fully liable for intent and gross negligence. For slight negligence, liability is limited to breach of essential contractual obligations and foreseeable typical damages. The Provider is not liable for data loss caused by the User or for technical disruptions outside its control.
§ 9 Availability
The Provider strives for high availability but does not guarantee 100% uptime. Maintenance is announced where possible and scheduled during low-usage periods.
§ 10 Changes to Terms
The Provider may amend these terms if necessary and without unreasonable disadvantage to the User. Changes are communicated by email. If the User does not object within 30 days, the amended terms are deemed accepted.
§ 11 Final Provisions
Swiss law applies. If individual provisions are invalid, the remaining provisions remain effective. The place of jurisdiction for all disputes is the registered office of Leftclick AG.
